in april 2004, oklahoma senate, vote of 38 7, , oklahoma house, vote of 92 4, approved of constitutional ban on same-sex marriage. on november 2, 2004, oklahoma voters approved oklahoma question 711, constitutional amendment bans same-sex marriage , legal incidents thereof conferred upon unmarried couples or groups . on january 14, 2014, judge terence c. kern, of united states district court northern district of oklahoma, declared question 711 unconstitutional. case, bishop v. united states (formerly bishop v. oklahoma), stayed pending appeal. 3-judge panel of tenth circuit heard oral arguments in bishop on april 17, 2014, , upheld district court s decision on july 18.
on october 6, 2014 united states supreme court turned down oklahoma s appeal reinstates lower courts ruling state s ban on same-sex marriage unconstitutional. following courts rejection of appeal oklahoma county court clerk s office , others across state started issuing marriage licenses same sex couples.
